... Part Three ... On January 24th, 2006 the Commission received a note signed
by the Chief of the Cuba Interests Section in Washington DC, in which he stated
that "The Inter-American Human Rights Commission had no jurisdiction and
the OAS moral authority to analyze this or any other issue on Cuba".
However, the jurisdiction of the Inter-American Commission on Human Rights to
monitor the situation of human rights in Cuba is derived from the terms of the
OAS Charter, the Statute and Regulations. Under the Charter, all Member States
undertake to respect the fundamental rights of individuals, in the case of States
not party to the Convention, are established in the American Declaration, which
is a source of international obligations. The statute requires the Commission
to pay particular attention to the observance of the rights recognized in
Articles I ( right to life , liberty , security and integrity of the person),
XVIII (right to justice) and XXVI (right to due process) of the Declaration to
exercise its jurisdiction with respect to countries that are not parties. In
