Let there be light Sixth Part Extraordinary 106

Articles 58 & 59, related below, are fictitious. Any similarity to other democratic and respected in real life Constitutions, is entirely coincidental and unintentional:
Article 58: Freedom and inviolability of persons is assured to all those who live in the country.
Nobody can be arrested, except in the manner, with the guarantees and in the cases indicated by law.
The persons who has been arrested or the prisoner is inviolable in his personal integrity.
Article 59: Nobody can be tried or sentenced except by the competent court by virtue of laws which existed prior to the crime and with the formalities and guarantees that the laws establish. Every accused person has the right to a defense. No violence or pressure of any kind can be used against people to force them to testify, All statements obtained in violation of the above precept are null and void and those responsible for the violation will be punished as outlined by law.
During the recently concluded April, the CCHRNC (Cuban Commission for Human Rights and National Reconciliation) could verify at least 905 arrests of peaceful dissidents, for purely political reasons, a very high figure but it does not reflect the increasing level of popular discontent, due to any individual or collective manifestation of it is a police or criminally prosecutable offense, since the government of Cuba, which has entered its 56th year exercising power, continues to criminalize the exercise of all civil and political rights and other fundamental rights. In the month of reference 90 cases of dissidents physically assaulted by police and paramilitary agents and other 104 who were victims of the so-called "acts of repudiation" and other forms of harassment or vandalism, usually against peaceful opponents' houses were identified. To this day the government of Cuba does not accept the full cooperation of the International Red Cross and other international NGOs on Human Rights, while, despite promises last year during the Universal Periodic Review of the Board of DD. HH. of the United Nations, they have not invited any of that organ Rapporteurs to visit Cuba for the same purpose of cooperation. To be continued...

Let there be light Sixth Part Extraordinary 105

Articles 56, 60 and 63, related below, are fictitious. Any similarity to other democratic and respected in real life Constitutions, is entirely coincidental and unintentional:
Article 56: The home is inviolable. Nobody can enter the home of another against his will, except in those cases foreseen by law.
Article 60: Confiscation of property is only applied as a punishment by the authorities in the cases and by the methods determined by law.
Article 63: Every citizen has the right to file complaints with and send petitions to the authorities and to be given the pertinent response or attention within a reasonable length of time, in keeping with the law.
On December 16th, 1996, five officials of the Castro regime, trasspassed my home and carried out an illegal search; they found 4 pounds of shrimp in the house refrigerator, which they expropriated giving preference to the Fishing Regulations above the Constitution of the Republic, violating the hierarchy of legal norms in the light of which a regulation can not prevail over a law. Almost immediately, on 01.30.97 I denounced these violations to the Attorney General's Office. Then on the 5.4.99 I accused Captain Orlando Diaz Padron, chief of Cienfuegos Fishing Inspection for defamation; and on 25/08/99 I accused the legal adviser of the minister of Fishing for prevarication. This maded me to accuse two judges of the Municipal and Provincial Court of Cienfuegos for prevarication on 04/24/2000. And afterwards on 25/4/2000, I accused Mayor Luis A. Coca Valdes, military judge, also for prevarication. Thereafter on 08.20.2000, I claimed the State Council for the separation of María del Carmen Romero, head of Civic Rights Protection at the Attorney General's Office of the Republic; and on 30.8.2000 I filed complaint with the Attorney General for obstruction in the Report procedure. Then on 29/08/2000 I sent a 2nd complaint to dictator Fidel Castro; and on 25.09.2000 I brought forth my 4th complaint to tyrant Raul Castro. Subsequently, on 5/11/2000 I formally requested an interview with the Attorney General of the Republic; and finally on 16/11/2001, I accused Juan Escalona, Attorney General of the Republic, for the frequent in Cuba crime of Prevarication; and on 25/03/02 I put a complaint for the usual obstruction of complaint procedure against the Attorney General; and after 6 years of constant Accusations and complaints, on 05.18.2002 the Attorney General's Office, in a total show of arrogance and disrespect for the constitution, laws and human rights, accused me of contempt without taking me declarations, or processing my complaint against the Attorney General.  To be continued...

Let there be light Sixth Part Extraordinary 104

The U.S. Embargo on Cuba should not be lifted up yet; for though thanks to it the Castros have been forced to raise their domestic Blockade on all Cubans, as the expropriation of all possessions before leaving the country, restricting the right to sell and buy houses, cars, cell lines; to staying in hotels, renting a car, to travel abroad, to develop talent and fortune in professional baseball, build self-employed business, etc; There are still serious limitations and violations of human rights in the island; as the repression, persecution and imprisonment for political opinions contrary to the regime, or for dissenting from the totalitarian government imposed for more than five decades. Los Castros, responsible for so many detriments and harms to the people of Cuba, persist in their monopoly of power and their failed socialist system, despite the dismal situation of the nation. The average salaries are a constant challenge to a decent life; the education system has become a manipulated fraud; the health system has deteriorated considerably; and basic food basket is depressing; leaving many cubans no other choice than to exile; and what is worse, the Cuban nationality is threatened to disappear, facing the decision of thousands and thousands of Cubans choosing other citizenships, seeking a different future, such as Spanish, for which the lines in its embassy are endless. Cubans, don't reject international solidarity, lifting the EMBARGO must be conditioned on the removal from power of the Castros, and the overthrow of the dictatorship!  To be continued...

Let there be light Sixth Part Extraordinary 103

Añadir leyenda
According Martinoticias, former Florida governor, Charlie Christ, has just declared that the U.S. embargo on Cuba should be lifted and that he wants to visit the island to see the reality for himself. I think that if Mr. Christ wishes to analyze this possibility, he should first visit Venezuela to see the slaughter of students that Castros Dictatorship is advising and supporting there; later he should visit the more than 2 million Cubans who have been forced into exile worldwide; and finally, if he still has any doubts, he should incognito visit Havana, Santiago, Villa Clara and other provinces, to see if he thinks that that failed dictatorial regime should be helped in continueing exploiting and repressing the Cuban people; and to see if he thinks that those communist dictators should be helped in continueing exporting its totalitarian model for South America and other continents. But what is more, I think that when in doubt, we Cubans must say NO to those who intend to help and support the Castro tyrants for more than five decades of human rights violations in the island! Castros, leave the Power! Down with Castro Communism! To be continued...

Let there be light Sixth Part Extraordinary 102

Article 55 of the Constitution of the Republic of Cuba, related below, is fictitious. Any similarity to other democratic and respected in real life Constitutions, is entirely coincidental and unintentional:
Article 55: The state, which recognizes, respects and guarantees freedom of conscience and of religion, also recognizes, respects and guarantees every citizen’s freedom to change religious beliefs or to not have any, and to profess, within the framework of respect for the law, the religious belief of his preference. The law regulates the state’s relations with religious institutions.
In the statutes of the Communist Party of Cuba it was stipulated as an obligation of the militants <<to fight against religious obscurantism>>, which meant, in practice, non-acceptance of believers in their lines; rejecting their admittance in state administration and in certain university careers. Discriminatory practices of the new regime would imply a serious social harm for believers and thousands of people, who were forced to hide their faith, in order not to be victims of government reprisals. And more recently, on May 3rd, 2014 the National Christian Alliance Board of directors has just written a letter to Dictator Raul Castro, in which they complain that the Office of Religious Affairs of the Central Committee of the Communist Party of Cuba has never wanted to recognize the true needs and even less contribute to the solution of problems faced by the nation in terms of religious matters. Quoting as an example of violation of the right to religious freedom, the boycott to the law draft of religious Worship and associations, delivered to the National People's Assembly since 2006 to be enacted the much needed "Law of Worship and Religious Associations ". The sum of the independent churches, the Apostolic Movement and Evangelical Ministries, exceed 500 institutions without being legally recognized. These suffer repression and limitations because they are not under a religious law, not counting the many non-Christian cults, which are unfortunately cornered into oblivion without a minimum of consideration.  To be continued....

Let there be light Sixth Part Extraordinary 101

Why does it call my attention that #LeilaNachawati, who describes herself as Hispanic-Syrian advocating activist of freedom of expression, and ignorant of the Cuban reality, attack a Cuban activist of freedom of expression? Isn't it a paradox? She manifests herself very receptive to hearing voices that bring her over the Cuban context which she has always found it difficult to understand. Then why hasn't she been to Cuba so that she can be acquainted with the difficult context in which Yoani defends freedom of expression, rather than simply be listening to voices? A picture is worth a thousand words; she should see the picture of the Cuban nation that the Castros and Socialism have made of Cuba. Leila Nachawati was called the attention by the admiration of #YoaniSanchez to the policies and institutions of Spain, whose reality, she says, is far from being a mirror to look in. And then she lists the most important problems that the country suffers, and she states that those who invite Yoani to Congress and chat with her about human rights in #Cuba have promoted the invasion of others, blaming Spain for the Iraqis' problems and not the Arabian Socialist dictator Saddam Hussein, who oppressed the country from 1979 to 2003. Fortunately she recognizes that Spain is a democracy, and that those politicians who wrap her up in her visit have won their elections. Although she points out proudly that to change that system that marginalizes them in decision-making, on May 15th, 2011, they regained the street and they continue and will continue out there. That, in Cuba, Leila, is not possible; there Yoani has to fight the most inflexible dictatorship of America. But what it is definitely very absurd to express, is that hobnobbing with the political elite Yoani legitimizes a system that a great many people struggle to change. For Leila Nachawati enemies of our enemies are not necessarily our friends. For her, "you will be judged by the company you keep" and "hearing voices" is more advisable. Actually, I do not know the company this writer keeps, nor what voices she listens to; but I do know who appreciated very much her article: the Castros, communist dictators of Cuba. Almost immediately they reproduced it entirely in their alternative information medium, #CubaDebate. And I really do not think that the #CatholicChurch has tried to legitimize the Cuban dictatorship when their popes have visited the island; nor I think #BarakObama has sought to legitimize the Cuban dictatorship when he shook hands with the tyrant #RaulCastro. Likewise I also think that #YoaniSanchez has only done what she could and has been allowed to, in order to fight the dictatorship that oppresses and exploits all #Cubans, including exiles, whom they frighten and extort with excessive taxes, prices, threats and reprisals.  To be continued...

Let there be light Sixth Part Extraordinary 100

On May 10th Havana lived the emotions of an impressive discipline, "Cliff Diving" or "leaping into the water from extreme heights" which challenges risk just as "Balserismo". Habana citizens felt this way in the first stage of the Cliff Diving World Series 2014, in Morro Castle. In contrast to the U.S. embargo on the Castro tyranny RED BULL sponsored the Championship in Cuba; which on one hand is an excellent advertising to encourage tourism to the slave island, on the other hand, the event served as a fitting tribute to those who daily with much more risk have also jumped into these seas in search for freedom.
The 14 best specialty divers came to this capital to make their jumps at a height of 27 meters, from a specially built platform for the event and which was placed on the cliff at the entrance to the capital's bay. Among the highlights were Colombian Orlando Duque, first monarch of the circuit in 2009, Russian Artem Silchenko 2013 champion and world ranking leader; and Briton Gary Hunt, three times winner of the event (2010, 2011 and 2012). Others were Czech Michal Navratil bronze in the 2011 version, American Steve LoBue, third in 2012; also Mexican Jonathan Paredes, bronze in the World Championships last year; and American Andy Jones and David Colturi, Kris Kolanus (Poland), Miguel García (Colombia), Jorge Ferzuli (Mexico), Brazilian Junior and Edivaldo Jucelino Keda and British Blake Aldridge who won the event. The world records are held by Swiss Oliver Favre, who jumped from 54 meters, on August 30th, 1987, in France, and U.S. Lucy Wardle, who did the same from 37 meters, on April 7th, 1985, in Ocean Park, Hong Kong.   To be continued...

Let there be light Sixth Part Extraordinary 99

Article 54 of the Constitution of the Republic of Cuba, related below, is fictitious. Any similarity to other democratic and respected in real life Constitutions, is entirely coincidental and unintentional:
Article 54: The rights to assembly, demonstration and association are exercised by workers, both manual and intellectual, peasants, women, students and other sectors of the working people, and they have the necessary means for this. The social and mass organizations have all the facilities they need to carry out those activities in which the members have full freedom of speech and opinion based on the unlimited right of initiative and criticism.
In Cuba not only there is no association that expresses a critical view of the policies and practices of the government and its leaders, but also those involved in groups, meetings or demonstrations without logic state approval are subject to harassment, discrimination and even criminal penalties, in most cases on charges of "pre-criminal dangerousness"; ie without having committed a crime but as a safety measure. It is well known by human rights observers that at trials in Cuba, courthouses judge dissidents with ideological and political criteria. Criminal penalties are imposed under the application of criminal laws whose vagueness and subjectivity provide broad discretion to the agents of the state to suppress any dissent against official policy, and the subordination of the courts to the State Council, headed by the Head of State represents a direct dependence of the judiciary to the guidelines of the Executive. Repeated reports prepared at the request of the CIDH have proven that Cuba is the only country on the continent where you can categorically say that there is no freedom of speech or assembly, or demonstration and association.  To be continued...
