Articles 121 , 122 & 128 of the Constitution of the Republic
of Cuba ... Part Two ... On January 6th, 2006 the Inter-American Commission on
Human Rights sent Cuba a report of observations, from which I extracted two
that show the falsity of the articles of the Cuban Constitution 121, 122 &
128 in question, and I quote . 75 In particular,
the Commission considers that full observance of the judicial guarantees
enshrined in the American Declaration is founded on an independent and
autonomous judiciary. The Commission has consistently held that there is
no separation between public authorities in Cuba so there is no guarantee of
justice administration free from interference from other powers . The Commission notes that the subordination of the
courts to the Council of State, presided over by the Head of State, constitutes the judiciary’s direct
dependence on the directives of the executive branch. Under this scheme,
the Commission considers that the Cuban courts do not effectively guarantee the
rights of the accused enshrined in the American Declaration. The Commission
finds that the lack of independence of the Cuban judicial system is a failure
to ensure the rights of the accused, especially in cases where there is a
political connotation. To be continued...

Articles 121,
122 & 128 of the Cuban Constitution, related
below, are fictitious. Any similarity to other democratic and respected in real
life Constitutions, is entirely coincidental and unintentional:
Article 121:
The courts constitute a system of state bodies which are set up with functional
independence from all other systems and they are only subordinated to the
National Assembly of People’s Power and the Council of State. The People’s
Supreme Court is the foremost judicial authority and its decisions in this
field are final.
Through its Governing Council it can propose and issue regulations; make decisions and enact norms whose fulfillment is compulsory for all courts and, based on their experience, it issues instructions which are also compulsory in order to establish uniform judicial practice in the interpretation and application of the law.
Article 122: The judges, in their function of administering justice, are independent and only owe obedience to the law.
Article 128:
The Office of the Attorney General of the Republic constitutes an organic unit
which is only subordinated to the National Assembly of People’s Power and the
Council of State. The Attorney General of the Republic is given instructions
directly from the Council of State. The Attorney General of the Republic will
handle the direction and control of all the work done by his office all over
the country. The bodies of the Office of the Attorney General are organized in
a vertical manner all over the country. They are subordinate only to the Office
of the Attorney General of the Republic and are independent of all local bodies.
On January 6th, 2006 the Inter-American Commission on Human Rights
sent Cuba a report of observations, of which I extracted two which demonstrate
the falsity of the articles of the Cuban Constitution 121, 122 and 128 in
question, and I quote : Part One ... 74 . During the period covered by this
report , the IACHR continued to receive reports of trials in which allegedly
Cuban courts , judge with processed ideological and political criteria as
opposed to judicial procedures that reflect Cuba 's international obligations
on human rights . In this regard, the Commission urges Cuba to bring its
procedures into line with international standards of due process, so that all
people who come to the courts to determine their rights and responsibilities
have minimum legal guarantees to exercise their defense . The Commission
considers that the existing legal framework does not meet Cuba 's international
obligations in this area. To be continued...

Los

Parte...

Let there be light Sixth Part Extraordinary 107
Article 74 of the Constitution of the Republic of Cuba,
related below, is fictitious. Any similarity to other democratic and respected
in real life Constitutions, is entirely coincidental and unintentional:
Article 74:
The National Assembly of People’s Power elects, from among its deputies, the
Council of State, which consists of one president, one first vice president,
five vice presidents, one secretary and 23 other members. The president of the
Council of State is, at the same time, the head of state and head of
government. The Council of State is accountable for its action to the National Assembly of
People’s Power, to which it must render accounts of all its activities.
This shameful manipulation of the Constitution of the
Republic of Cuba has ensured the perpetuation of the totalitarian and
dictatorial power of the Castros, since they reduce to 600 prejudiced,
influenced, pressured and compromised citizens, the total of "voters"
who are allowed to "choose" the President and other members of
the ruling elite of the nation, with the additional fraud of "single
party", the "united vote" and the self-called "historic
leaders". And if to this undemocratic and shameful election we add the political
apathy, corruption and double standards which have reigned and are reigning in
this National Assembly, where we come to know, despite the lack of transparent
information and the secrecy that characterizes Castros' regime, scandalous
cases like: José
Padrón, destituted for corruption in the Tourism Ministry(1976-1986); Luis
Orlando Domínguez of the Institute of Civil Aviation(1978-1987) condemned to 20 years in prison for corruption
and conspiracy; Arnaldo Ochoa of the Armed Forces degraded, tried on drug
charges and executed on July 13th, 1989; Jose Abrantes of
the Interior Ministry(1985-1989) dismissed for tolerance in the Ochoa case,
abuse of power, neglect of duty and misuse of resources and convicted to 20
years for corruption; Diocles Torralbas
of the transporting Ministry(1985-1989) prosecuted for corruption and conspiracy
in June 1989 and a month later sentenced
to 20 years on charges of malversation, abuse of authority and misuse of
resources; Levi Farah
Balmaseda of the Ministry of Construction Materials(1987-1989)
destituted for corruption and conspiracy; Marcos Lage Coello of the Ministry of
Iron and Steel-Mechanics and Electronics Industry(1977-1990) dismissed for
corruption; Victoria Velázquez of the Union of Young Communists(1994-1997)
dismissed for corruption; Roberto Robaina of
the Ministry of Foreigh Affairs(1993-1999) destituted for corruption and lack
of confidence; Orlando Rodríguez
Romay of the Fishing Ministry(1995-2000) dismissed for
irregularities in his administration on corruption in his Ministry; Nelson
Torres of the Ministry of the Sugar Industry(1993-1997) dismissed for corruption;
Ibrahim Ferradaz of the Tourism Ministry(1999-2004) dismissed for corruption; Ignacio
González Planas of the Ministry of Informatics and Communications(2000-2005)
dismissed for corruption and negligence; Juan Carlos Robinson of the Political
Bureau of the Communist Party deposed from office in April 2006 for "abuse
of power'' and "softening and indiscretions'' and was sentenced two months
later to 12 years in prison for influence trafficking; Fernando Remirez of the
Ministry of Foreign Affairs(1992-2009) dismissed for serious deficiencies and
serious "irregularities", including payment of bribes, malversation
and diversion of resources abroad; Carlos Lage of the State Council(1992-2009)
dismissed for conspiracy; Felipe Pérez Roque, of the Ministry of Foreign
Affairs(1999-2009) dismissed for conspiracy; Otto Rivero of the State Council(2004-2009)
dismissed for lack of trust and conspiracy; Alejandro Roca of the Ministry of
Food Industry(1976-2009) tried for corruption and sentenced to 15 years in
prison. We must add to these cases many others dismissed for negligence, for
inefficient control, deficiencies in office or personal and strategic
differences, among which we stand out Osmani Cienfuegos(1994-1999), Marcos
Portal(1983-2004), and Yadira Garcia(2004-2010); or Luis Ignacio Gómez, Member
of the Central Committee of the Communist Party and Minister of Education for
almost 18 years, who was removed from office in April 2008 for loss of "Energy
and revolutionary consciousness'', and "having traveled abroad more than
70 times '' in a decade "using the pretext of international cooperation''.
Besides, if we consider all those released from their posts, those who have
resigned, or have defected abroad as General Rafael del Pino and others, there
are plenty of arguments to demonstrate the illegitimacy of the Castros. To be continued...

Articles 58 & 59,

in real life Constitutions, is entirely coincidental and unintentional:
Article 58:
Freedom and inviolability of persons is assured to all those who live in the

Nobody can be arrested, except in the manner, with the guarantees and in the cases indicated by law.
The persons who has been arrested or the prisoner is inviolable in his personal integrity.

The persons who has been arrested or the prisoner is inviolable in his personal integrity.
Article 59:
Nobody can be tried or sentenced except by the competent court by virtue of
laws which existed prior to the crime and with the formalities and guarantees
that the laws establish. Every accused person has the right to a defense. No
violence or pressure of any kind can be used against people to force them to
testify, All statements obtained in violation of the above precept are null and
void and those responsible for the violation will be punished as outlined by
law.
During the
recently concluded April, the CCHRNC (Cuban Commission for Human Rights and
National Reconciliation) could verify at least 905 arrests of peaceful
dissidents, for purely political reasons, a very high figure but it does not
reflect the increasing level of popular discontent, due to any individual or
collective manifestation of it is a police or criminally prosecutable offense,
since the government of Cuba, which has entered its 56th year exercising power,
continues to criminalize the exercise of all civil and political rights and
other fundamental rights. In the month of reference 90 cases of dissidents physically assaulted by
police and paramilitary agents and other 104 who were victims of the so-called
"acts of repudiation" and other forms of harassment or vandalism,
usually against peaceful opponents' houses were identified. To this day the
government of Cuba does not accept the full cooperation of the International Red Cross and other international NGOs on Human Rights, while, despite promises
last year during the Universal Periodic Review of the Board of DD. HH. of the United
Nations, they have not invited any of that organ Rapporteurs to visit Cuba for
the same purpose of cooperation. To be continued...

Article 60:
Confiscation of property is only applied as a punishment by the authorities in
the cases and by the methods determined by law.
Article 63:
Every citizen has the right to file complaints with and send petitions to the
authorities and to be given the pertinent response or attention within a
reasonable length of time, in keeping with the law.
On December 16th, 1996, five officials of the Castro regime, trasspassed
my home and carried out an illegal search; they found 4 pounds of shrimp in the
house refrigerator, which they expropriated giving preference to the Fishing
Regulations above the Constitution of the Republic, violating the hierarchy of
legal norms in the light of which a regulation can not prevail over a law.
Almost immediately, on 01.30.97 I denounced these violations to the Attorney
General's Office.
Then on the 5.4.99 I accused Captain Orlando Diaz
Padron, chief of Cienfuegos Fishing Inspection for defamation; and on 25/08/99
I accused the legal adviser of the minister of Fishing for prevarication. This maded me to accuse two judges of the Municipal and
Provincial Court of Cienfuegos for prevarication on 04/24/2000. And afterwards on 25/4/2000, I accused Mayor Luis A. Coca Valdes,
military judge, also for prevarication. Thereafter on 08.20.2000, I claimed the
State Council for the separation of María del Carmen Romero, head of Civic Rights
Protection at the
Attorney General's Office of the Republic;
and on 30.8.2000 I filed complaint with the Attorney General for obstruction in
the Report procedure. Then on 29/08/2000 I sent a 2nd complaint to dictator
Fidel Castro; and on 25.09.2000 I brought forth my 4th complaint to tyrant Raul
Castro.
Subsequently, on 5/11/2000 I formally requested an
interview with the Attorney General of the Republic; and finally on 16/11/2001,
I accused Juan Escalona, Attorney General of the Republic, for the frequent in
Cuba crime of Prevarication; and on 25/03/02 I put a complaint for the usual obstruction

constant Accusations and complaints, on 05.18.2002 the Attorney General's

Let there be light Sixth Part Extraordinary 104
The U.S. Embargo on Cuba should not be lifted up yet; for
though thanks to it the Castros have been forced to raise their domestic Blockade
on all Cubans, as the expropriation of all possessions before leaving the
country, restricting the right to sell and buy houses, cars, cell lines; to
staying in hotels, renting a car, to travel abroad, to develop talent and
fortune in professional baseball, build self-employed business, etc; There are still
serious limitations and violations of human rights in the island; as the
repression, persecution and imprisonment for political opinions contrary to the
regime, or for dissenting from the totalitarian government imposed for more
than five decades. Los Castros, responsible
for so many detriments and harms to the people of Cuba, persist in their
monopoly of power and their failed socialist system, despite the dismal
situation of the nation. The average salaries are a constant challenge to a
decent life; the education system has become a manipulated fraud; the health
system has deteriorated considerably; and basic food basket is depressing;
leaving many cubans no other choice than to exile; and what is worse, the Cuban nationality is threatened to
disappear, facing the decision of thousands and thousands of Cubans choosing
other citizenships, seeking a different future, such as Spanish, for which the lines
in its embassy are endless. Cubans, don't reject international solidarity,
lifting the EMBARGO must be conditioned on the removal from power of the
Castros, and the overthrow of the dictatorship! To be continued...

prevalecen serias limitaciones y violaciones de los #Derechos Humanos en la Isla;

According
Martinoticias, former Florida governor, Charlie Christ, has just declared that
the U.S. embargo on Cuba should be lifted and that he wants to visit the island
to see the reality for himself. I think that if Mr. Christ wishes to analyze
this possibility, he should first visit Venezuela to see the slaughter of
students that Castros Dictatorship is advising and supporting there; later he
should visit the more than 2 million Cubans who have been forced into exile
worldwide; and finally, if he still has any doubts, he should incognito visit
Havana, Santiago, Villa Clara and other provinces, to see if he thinks that that
failed dictatorial regime should be helped in continueing exploiting and
repressing the Cuban people; and to see if he thinks that those communist
dictators should be helped in continueing exporting its totalitarian model for
South America and other continents. But what is more, I think that when in
doubt, we Cubans must say NO to those who intend to help and support the Castro
tyrants for more than five decades of human rights violations in the island! Castros,
leave the Power! Down with Castro Communism! To be continued...
